Divorce
It is time to open the curtain and let the world know what really goes on in a Family/Divorce Mediation. It is not there to make your life miserable. Mediation is truly an opportunity for the parties to have direct input into the settlement process. It is not something to fear. It is an informal opportunity to work back and forth with your spouse to reach an amicable settlement agreement.

There are so many emotional and financial issues associated with the process which can make it seem devastating. Issues surface that were never a concern prior to filing for divorce. Who is responsible for making the decisions concerning our child’s health care, education, and after school activities? What about day care (where, when, who pays)? Fraud
When filing for Chapter 7 Bankruptcy one of the more difficult tasks for a client is to inventory and value the property which is listed on the schedules and submitted to the Bankruptcy Court. Valuing common household items is not as daunting a task as it seems. General household items are valued at liquidation values or the prices normally found at a garage sale. Personal property with true intrinsic value (i.e. antiques, jewelry, collectables, etc...) should be appraised. It is very important to be honest and fully disclose the value of your property. Bankruptcy Fraud is no laughing matter and is very serious. Construction Litigation
Another issue that comes up often with performance is the time for completion and payment. This is a huge issue and one that should be specifically addressed at the beginning of the contract period. I represent both payors and payees. If my client is paying for something, I want them to hold back as much as possible until they are satisfied. If my client is receiving money, I want as much money upfront as possible. There have been too many scenarios where this critical element has left the parties at an impasse. This happens often in construction contracts where the homeowner has paid for 95% of the contract at a point where the contractor has only been obligated to complete 30% of the job. When there are contracts with a draw, think about what you are doing. Do not blind sign a contract.
Real Estate Transactions
There are two types of title insurance policies: a lender’s policy and an owner’s policy and before either of the policies are endorsed, the closing agent will first review a title commitment. A title commitment is the document by which a title insurer discloses to all parties connected with a real estate transaction all the liens, defects, and burdens and obligations that affect the subject property.

Personal Injury
Civil litigation is a broad area and incorporates actions between individuals, organizations, partnerships, corporations, LLC’s, and any other legal entity which may be able to establish legal standing to bring or defend an action. The causes of action can range from Breach of Contract and Tortious interference with a contractual relationship to Fraud or personal injury. Medical Malpractice
Another very common area of Civil litigation is negligence. For there to be negligence, in general, there must be a duty to perform some action, a breach of that duty by the party responsible for the performance, and damages resulting from that breach. The damages have to show a degree of proximity to be associated with the breach of the duty and there must be damages of some kind. This is a very general outline of what is need to prove negligence. There is a tremendous amount of statutory and case law defining the relationships, duties, and degrees of these duties. There are also defenses available to the party accused of negligence (assumption of risk, contributory negligence, etc...). Negligence is a very broad area of the law and includes the areas of Medical Malpractice, Breach of Fiduciary Duty, Negligent Hiring, Negligent infliction of emotional distress...the list is almost endless.

Bankruptcy
Clients do not normally understand the differences between Chapter 7 Bankruptcy and Chapter 13 Bankruptcy. Normally most clients think Bankruptcy is Bankruptcy. Chapter 7 Bankruptcy is a liquidation Bankruptcy versus a Chapter 13 Bankruptcy which is a debt restructure. Chapter 7 Bankruptcy requires clients to have income below the median income set forth by the U.S. census for the State of Florida or to qualify under the means test. Chapter 7 Bankruptcy may require the client to turn unprotected assets over to the Bankruptcy Trustee to satisfy creditors. This video is a brief explanation of Chapter 7 Bankruptcy.
