Child Support
California has statutory child support guidelines. The amount of child support that parents must pay is based on a formula established under California’s law. This formula takes into account several factors, including the income of each parent, the amount of time each parent has with the child, and the number of children involved. The duty to support children extends to both parents and normally continues until the child reaches the age of 18, but may be extended until age 19 in some cases.
Child Custody and Visitation
Child custody is one of the most sensitive and complex issues dealt with by any court. In child custody cases, there are many possible outcomes, and many issues that the court must take into consideration. Child custody battles are often very difficult situations for all parties involved, including the children. It is important to protect your interests and those of your children by choosing a lawyer who understands how to best reach a resolution of your custody issues, with as little turmoil as possible, and while also achieving your custody goals.
Premarital Agreement
A premarital agreement (or prenup) is an agreement that defines how property will be acquired during marriage, and how property will be divided upon dissolution of the marriage. Domestic partners may enter into a pre-registration agreement.
Spousal Support
California courts have broad discretion to determine the amount and the duration of spousal support. The courts takes into account a number of factors including the length of the marriage, the living standards of the parties, the marketable skills of each party, and the ability of the supporting spouse to pay support. Spousal support can be awarded to either party on a temporary or permanent basis. Spousal support may be ordered on a temporary basis, in order to maintain the marital standard of living while a divorce is in process. Spousal support may also be ordered on a long term basis. The primary purpose of long term spousal support is to help the supported spouse become self sufficient again.
