Wrongful Termination
However, when settlement is at least a remote possibility, mediation can bring the parties together and get the deal done. Common types of lawsuits that end up in mediation include breach of contract disputes, injury and tort cases, wrongful termination claims, family law matters, and more. Cases that are not appropriate for mediation include OWI and criminal charges, bankruptcy, deportation, and related immigration matters, disability appeals, and any other types of cases prosecuted by the government. Cases that do not involve an active dispute, such as estate planning matters or real estate transactions, are also not good candidates.

A real estate agreement between a buyer and seller of real estate is governed by general principles of contract law and individual state laws. The sale or transfer of real property is almost always required to be in writing. It is often required in real estate contracts that the title to the property sold be â€œmarketable.â€ An attorney or a title insurance company is frequently employed to investigate a titleâ€™s legal marketability.
Landlord-Tenant Disputes
Consider, for instance, a tenant who may be lagging a week or two behind on their rent payments each month. Perhaps the landlord allows for a grace period, imposing a late fee on the tenant, or not. Either way, should the tenant fall outside of the grace period, even by a day, they could be subject to a landlord-tenant claim whereby the landlord, through their attorney, attempts to collect not only back rent, but the costs associated with the case, including statutory attorneyâ€™s fees, typically $75.00.

From 2001 to 2023, Mr. Maul served as a law enforcement professional on active duty in the United States Air Force. He focuses his practice in probate and estate planning (wills, trusts, etc.), elder and disability law, and business and employment Law. Mr. Maul is a Veteranâ€™s Administration accredited attorney, as well as a member of the Iraq and Afghanistan Veteranâ€™s Association. He is a member of the State Bar of Michigan, the American Bar Association, and the Lions Club of Hamilton Michigan. Mr. Maul continues to serve his country as a member of the Michigan Air National Guard. Additionally, he is a contributor on legal topics with ICLE and NBI as well as a member of the West Michigan Estate Planning Council. Additionally, Morgan is trained mediator in Texas and Michigan and volunteers his time as a mediator with Mediation Services of Holland, Michigan.

Objections to the availability of bankruptcy are bountiful, with a majority relying on implicit â€œmoralâ€ arguments that too often miss the point. In the commercial realm, anti-bankruptcy arguments tend to be a bit more sophisticated. For example, in an era of global trade in goods and services where state-backed subsidies are typically frowned upon, Chapter 11 bankruptcy protection in the United States is perceived as â€œcheating.â€ For instance, in the realm of air services trade where European states have long publicly subsidized their respective air carriers, the U.S. has cried foul since its airlines are ostensibly exposed to the forces of raw competition without recourse to the public piggyback when times get tough. While the creation of a common aviation market within the European Union has reduced the availability of subsides for Union member state carriers, these airlines argueâ€”with some plausibilityâ€”that Chapter 11 operates in much the same way as a subsidy, shielding U.S. airlines from the natural effects of competition, namely exiting the market altogether.

There is a common misconception among debtors, lawyers, and judges that when someone is sued on a debt, say medical or consumer debt, that they not only owe that debt, but they have no valid defenses or counterclaims against the party suing them.
