Child Support
Annulment
Cancellation of Driver License: The annulment or termination by formal action of the Director of Public Safety of the person’s driver license because of error or defect in the application process. (Generally, the applicant failed to disclose a pre-existing suspension or license removal action in another state and the Department of Public Safety did not discover this pre-existing condition until the National Driver Register issued notice to the license state.) A cancellation is neither a suspension nor a revocation, but a type of license removal that requires the disqualified licensee to clear the previous state before being eligible to hold an Alabama driver license.

Criminal Defense
As a former police academy instructor and graduate of the FBI Academy, Mr. Mahaney has trained hundreds of law enforcement officers in the areas of constitutional law, evidence, criminal law, and criminal procedure. Mr. Mahaney is also a frequent guest lecturer to lawyers in a number of Continuing Legal Education programs. In addition, Mr. Mahaney has continued to educate himself in his chosen field, recently completing advanced training in forensic chromatography under the auspices of the University of Texas – Arlington, School of Chemistry and Physics.
DUI/DWI
Although pleading guilty may seem the fastest and easiest way of handling a DUI offense, a DUI conviction can seriously affect your life and your future. Jail time, loss of driving privileges, mandatory probation, heavy fines and high court costs will result from a conviction. Suspension or revocation of your driver license will cause a disruption in your ability to work or support your family. In many cases, a suspended or revoked driver license as a result of a DUI conviction will result in job termination. In addition, under Alabama's revised ignition interlock law, you will be required to install an ignition interlock device for most "first offense" convictions and all second and subsequent convictions.
Traffic Violations
Suspension of Driver License: Suspension of driver license or privilege is the temporary or limited time period removal of a driver license or privilege. Suspension actions may be discretionary or mandatory, depending on the statute authorizing the suspension action. Reinstatement of driver license following a suspension order is generally accomplished upon completion of specified compliance requirements, such as settling an unpaid or ‘outstanding’ traffic violation, or the serving a limited duration license removal as a consequence of a conviction, and the payment of the required reinstatement fee to the Department of Public Safety.
Misdemeanors
Any person who violates Section 32-6-49.4 shall be guilty of a Class B misdemeanor and, upon conviction thereof, shall be sentenced or fined, or both, as provided by law.
Drug Crimes
Current Employment: Attorney in private practice located in Montgomery, Alabama since July 2006, with area of concentration in the defense of driving under the influence (DUI) and alcohol related offenses, drug crimes and violations, driver license law, and general criminal defense.
Assault
Murder
1 Caveat: Code of Alabama, 1975, section 32-5-316 authorizes “any court of competent jurisdiction” trying a case involving the operation of a motor vehicle and the violation of any criminal statute or ordinance to enter an order, in its discretion, forbidding the operation of a motor vehicle upon any public road or highway for a period specified by the court or perpetually, as the court may determine. In the 30+ years this editor has worked in traffic law/law enforcement, I have only seen one such court ordered entry and that was a DUI related fatality prosecuted as murder, and upon conviction, the trial court entered a lifetime revocation of driver license against the defendant.
Homicide
Mr. Mahaney’s background as a State Trooper and his time spent as an Assistant Attorney General and attorney for the Alabama Department of Public Safety contribute to his substantial knowledge in this specific area of law. While serving as a state trooper, he completed the Department’s Traffic Homicide course and served an advanced-level accident investigator.
Manslaughter
Conviction for negligently causing the death of another person while driving a commercial motor vehicle. [49 CFR 383.51(b)(8)] Note: Alabama refers to negligent motor vehicle death convictions as “manslaughter or homicide by vehicle” - One year revocation of Class D operator’s license under Code of Alabama section 32-5A-195(j)(1) and Alabama Administrative Code.
