In addition to criminal law that provides for the punishment of anyone who physically assaults another person, the Elder Abuse and Neglect Act requires the state of Illinois to investigate complaints about elder abuse, including in nursing homes.
DUI/DWI
Despite advances in safety features, car crashes remain a common cause of serious injuries throughout Southern Illinois. Typically, accidents don’t simply “happen” – they are caused. Some form of driver carelessness is almost always at the root of a collision. Common examples include recklessness, speeding, driver distraction, drunk driving and aggressive driving. They may be “man’s best friend,” but dogs retain the ability to cause serious personal injuries when they attack. Dog bites are particularly dangerous for children and seniors. If you have been injured by someone else’s dog, you may be able to seek compensation. Wills
In a best-case scenario, the court can certifying the decedent’s last will and testament as authentic and, once taxes and debts are satisfied, all remaining assets can be distributed as outlined in the will. Overall, an uncomplicated probate process can finish in about a year.
Trusts
If you have a special needs child or grandchild you must become aware that leaving the disabled child money outright or in cash will disqualify that child for any government benefits that they could receive. SI Elder Law can create a special needs trust that will allow them to receive an inheritance and still receive government benefits.
Power of Attorney
Everyone over the age of 18 should have a Power of Attorney for Health Care and a Power of Attorney for Property. A Disability can be either a physical disability or a mental disability. In both circumstances, the person with the disability may need the help of other people to pay bills, or to make medical decisions for them. In order for another person to have the legal authority to provide that help, they should have validly executed durable powers of attorney. The Illinois statutes set out a Statutory short form power of attorney but this short form does not give the agent enough powers to effectuate an elder plan to avoid paying the high cost of long term care. SI Elder Law takes the Statutory Short Form Powers of Attorney and empowers the agent to do all of the necessary things to accomplish an elder plan.
