Child Support
In children's issues cases, modifications of time-sharing arrangements or parenting plans may occur based on changes to living circumstances of the parties, repeated refusals to comply with time-sharing or parenting plans, intended relocation or other issues that may arise including new relationships, unforeseen circumstances, or any other factor manifestly affecting a child's well being. Children's issues whether involving time-sharing, parenting plans, parental responsibility, child support, or otherwise are always adjudicated based on the best interests of the child standard. The Court has wide discretion in determining what is in the best interests of a child when making findings and adjudications however it may recognize and weigh both parent's interests while making these determinations.
Child Custody and Visitation
Historically in the State of Florida, the terms custody and visitation were used to describe the relative roles of parents and their living circumstances with their children. More recently, the terms primary residence and contact or access became the legal terms to describe these living arrangements. At the present time, the Court utilizes and adjudicates time-sharing arrangements for parents under parenting plans which govern how the parties may communicate, make decisions, and otherwise co-parent their children in their separate households.
Paternity
There is a wide array of children's issues involved in divorce and paternity proceedings. Children's issues (even in paternity cases) are generally governed under the Dissolution of Marriage Statute in Chapter 61 of the Florida Statutes.
Premarital Agreement
Post-nuptial agreements are entered into between spouses during their marriage (or as Marital Settlement Agreements at the time of divorce) in order to define rights between them upon termination of their marriage. While similar to prenuptial agreements, post-nuptial agreements require full disclosure of income & expenses and assets & liabilities. As a safeguard, it is advised that such full disclosure also be made when entering into prenuptial agreements.
Guardianship
The Florida Statutes provide no presumption in favor of a mother or father where children issues are concerned, although under Chapter 744.301 of the Florida Statutes governing natural guardianships, the mother of a child born out of wedlock is legally considered to be the natural guardian of the child unless and until such time that a court of competent jurisdiction enters an order or judgment stating otherwise.
Spousal Support
Alimony, also known as spousal support, is technically defined as subsistence of financial support provided from one spouse to the other during divorce proceedings or following a divorce decree in order to provide financial maintenance for that spouse.
Legal Separation
Divorce or Dissolution of Marriage is technically the legal separation of a Husband and Wife effectuated by a Judgment, Order, or Decree entered by a court of competent jurisdiction which results in a legal severance and dissolution of the parties' marriage.

Prenuptial agreements are entered into between parties contemplating marriage in order to solidify and define certain rights and obligations between them. Some prenuptial agreements may be simple while others may be complicated and involve conjunction with estate planning.
