Jonathan E. Spitz Jonathan E. Spitz is a partner with the firm and represents clients in matters involving estate planning and administration; probate litigation; guardianship and conservatorship issues; and corporate formation. Jonathan graduated from Wofford College and received his Juris Doctor from the Charleston School of Law where he served as a research assistant to Professor Ginny Meeks. After law school, Jonathan clerked for the Honorable Amy W. McCulloch, Probate Judge for Richland County and has his Masters of Laws Degree in Taxation from the University of Alabama School of Law. Jonathan has been selected as a "Rising Star" in the area of Estate Planning and Probate in the 2018 and 2019 editions of Super Lawyers as well a 2019 Member “Legal Elite of the Midlands” by the Columbia Business Monthly Magazine in the field of “Tax & Estate Planning Law.”
Limited Liability Companies
Our firm handles a number of tax issues ranging from preparation and advisement regarding the creation of Limited Liability Companies, Partnerships, non-profit organizations (including applying for and maintaining 501(c)(3) tax-exempt status) as well as advising clients on estate taxation, gift taxation, generation skipping transfer taxation, and federal and state income taxation issues (individual, corporate, partnership and fiduciary). Attorneys in our firm have prepared and handled the filing of United States Estate Tax Returns. Estate Planning
A conversational guide to estate planning. It is, in written form, the questions (with answers) that we frequently receive from clients in the office. It provides an overview of complex questions. Do not use this book as a substitute for qualified legal advice. Use it to be better prepared when you seek help from a lawyer. The book is simply the answers to the questions that we find people are asking. They are written conversationally and simply. In fact, they are greatly oversimplified. We have tried not to use alot of legalese and we have included examples where they are helpful. We have even inserted a few diagrams because those are especially helpful in our practice. It is not written to be read like a novel or textbook. It is written with the premise that most people will look up specific topics or specific questions. Each chapter and often each question is intended to stand alone. For that reason, there is some overlap between chapters and sometimes between questions. We have given the rights to this book to the South Carolina Bar Association and you can order one from them for $25 online. We do have a limited number of these books at our office for purchase.
Wills
The lawyers at our firm assist clients with their estate planning needs by advising clients on wills, revocable and irrevocable trusts, business succession issues, gifting strategies, tax issues, and other matters. We also assist clients with creating general powers of attorney, health care powers of attorney, and living wills. When estate planning clients call our office to set a first appointment, they are sent a package of information explaining the estate planning process, including a booklet written by Al Todd. Clients are also sent an estate analysis checklist, which should be completed prior to the first conference for estate planning. Because we bill hourly for most matters, completing the checklist and being organized at the time of the first conference saves us time and thus saves you money. There is no charge for the initial information mailed to clients.
