Child Support
I am my husband’s legal guardian...he has alzheimers...he was awarded a huge amount of money in disability....BUT he owed back child support therefore about 80% went to child support...in doing our taxes this year the cpa informed me that he will have to pay the irs on the full amount which he was awarded...he does not even have that left over from what he was awarded. He informed me that the irs may come after me for that money. I do not have that kind of money. He suggested I file for divorce to protect myself.

The fees listed below are for the most common types of planning that our office provides. More complex situations may require higher fees or billing on an hourly rate. Guardianship cases are typically billed on an hourly basis. Probate cases may be billed as a flat rate, percentage, or on an hourly basis depending on the dynamics. You will be able to find "cheaper" prices for documents, however there is no substitute for the legal advice and counsel that you get from your attorney.
Spousal Support
If you receive SSI, the funds received via the QDRO (Qualified Domestic Relations Order) could impact y our benefits. Those funds can typically be converted to non-countable assets or placed in a special needs trust to protect benefits. Alimony or Spousal Support payments can generally be assigned to a SNT and not count as income against SSI.

DUI/DWI
My husband and I have solely raised & supported our grandson for at least 5 yrs. We have no contact info for mother or father (which never married.) Mother has had 3 DUI’s in a 5 yr period, and our understanding is she’s addicted to prescription pain pills. In the first 6 yrs. of his life the mother & grandson moved 17 times. I’d like to know if getting some type of legal guardianship is possible? Would this be considered abandonment? Any advise would be greatly appreciated. Thank you in advance.

Real Estate Transactions
If the Power of Attorney was properly executed under the other state’s laws, then it may be used in Florida, but its use will be subject to Florida’s Power of Attorney Act and other state laws. The agent may act only as authorized by Florida law and the terms of the Power of Attorney. There are additional requirements for real estate transactions in Florida, and if the Power of Attorney does not comply with those requirements its use may be limited to banking and other non-real estate transactions. The third person may also request an opinion of counsel that the Power of Attorney was properly executed in accordance with the laws of the other state.

How does someone get Medicaid? There are generally two ways to get Medicaid in Florida. One, if you receive Supplemental Security Income (SSI), you automatically get Medicaid. This is commonly called community Medicaid. All Medicaid programs in Florida are now HMOs. They cover things that a normal HMO policy might cover, except that your network of doctors and providers might be smaller than some other privately available insurance plans. Don't get SSI and SSDI (Social Security Disability Insurance) confused. SSDI is for individuals who have worked at least 40 quarters and paid into the system. SSDI does not have an asset cap and approximately 2 1/2 years after the date of disability the recipient will get Medicare. SSI has a asset limit of $2,000 for an individual and $3,000 for a couple.
Medicaid Planning
In my practice I do use lady bird deeds. However I usually use them in connection with Medicaid planning and we are fairly sure the client doesn’t have many years left and that they are also unlikely to sell or re-convey the property to another party.

Trusts and Estates

Estate Planning
If you still want the same to happen after you are married, you will have to enter into a pre-marital agreement. Without the pre-marital agreement, you will not be able to leave your house (assuming you and spouse are living in it at the time of your death) to your children. Leaving your house to your children in that case would result in a life estate to your spouse and remainder to your children. Spouse would have the option to convert to 1/2 ownership and sell property. Your spouse would also be entitled to the elective share, approximately 30% of the estate. To be as sure as you can be it would be best for you and your spouse to have independent legal advice as it relates to the pre-marital agreement. These are fairly common situations and you should not have a hard time finding an estate planning attorney familiar with these issues. It is also not uncommon that the estate planning attorney work with a family law attorney as it relates to the agreement. good luck.
Wills
You can probably purchase a Last Will and Testament at Office Depot or online but I would not recommend it at all considering you have a special needs son and you have a blended family.
Trusts
You have options. You can avoid probate by the use of a revocable living trust. If you choose not to place your assets in trust, you can still leave them in trust for your son. In doing so, nothing will have to be done regarding your son’s benefits when you pass. You also have the ability to name a trustee and successor trustees to manage the assets. Whether or not you use a revocable living trust for yourself, you should name a guardian for your son should something happen to you and your husband.
Power of Attorney
My mother died a few months ago. I have an executed, notarized, durable power of attorney. Can that DPOA be used after death?

Foreclosure
To answer your first question, dropping a party usually refers means that the foreclosure attorney is dropping a person from the foreclosure action. Typically when a foreclosure case is filed, the attorneys will name everyone possible to make sure that no one can later claim that they are the rightful owners of the property. Some, but not all foreclosure attorneys will drop parties from the lawsuit when it is discovered they have no interest in the foreclosed property or if they waive their rights to judgement.
Tax Law
Anyone can establish a special needs trust and, if the trust is properly drafted to account for tax planning, in certain situations gifts into the trust could very well reduce the size of the donor's taxable estate. As if these are not enough reasons to create a trust, elderly people who are attempting to qualify for long-term care coverage through Medicaid can transfer their assets into a properly drafted third-party special needs trust for the sole benefit of a person with disabilities without incurring a transfer-of-assets penalty, allowing the elder to qualify for Medicaid and making sure that the person with disabilities is taken care of in the future.
