Divorce
Although many divorce and family law cases begin as the result of contentious and emotionally charged circumstances, the majority of domestic relations issues are eventually resolved by written agreement. Not only do families benefit from the resolution of issues through settlement, but the laws and public policy of Virginia favor the use of settlement agreements to resolve legal disputes.
Child Support
Child support issues arise both in the context of divorce cases and when unmarried parents separate. Regardless of marital status, each parent of a child has a duty to support that child, and the rules regarding child support apply equally to both married and unmarried parents.
Child Custody and Visitation
Despite the common belief that all court cases result in a winner and a loser, cases involving the custody and visitation of children are rarely so black and white. When determining custody and visitation, Virginia law is generally based around the fundamental principal that, regardless of the parties or the circumstances, a child’s “best interests” must be protected. This standard is highly subjective, and affords judges with wide discretion when deciding custody and visitation matters.
Adoption
In certain, “uncontested” cases, biological parents consent to an adoption, such as is often the circumstance in “stepparent adoptions,” or where a parent has previously placed a child into foster care or with an adoption agency. In situations such as those, the complexity of the adoption process is somewhat tempered by the cooperation of the parties and/or governmental agencies involved. However, not all would-be adoptive parents enjoy the luxury of cooperation, and not all biological parents are willing to consent to the termination of their relationship with their child. Often adoption cases require contested litigation in court, and result in extensive investigation and involvement by local social services departments and other governmental agencies.
Premarital Agreement
Prenuptial Agreement. Some couples choose to enter into an agreement prior to their marriage, with the goal of preemptively resolving a number of issues that may arise as the result of future death or divorce. Prenuptial agreements are commonly used when one or both parties have children from a prior marriage, or when one or both parties have substantial assets that they wish to protect from otherwise applicable incidents and consequences of their pending marriage.
Spousal Support
Spousal Support is one of the more emotional and difficult of the divorce issues. While monetary issues are typically prevalent in dealing with spousal support, non-economic issues, such as the degree to which one party was responsible for the breakdown of the marriage, must also be taken into account and dealt with. Those non-financial issues are often the primary source of emotional contention over spousal support, particularly where one or both parties cling to pre-conceived notions that they "deserve" to receive or not pay support because of non-financial circumstances related to the marriage or the breakdown of the marriage.
