Employment Discrimination

Employment Contract
Once you have established your company and are ready to start hiring, it is important to have an Employment Contract ready for them to sign before coming to work for you. Employment contracts are important because they set the terms and expectations of employment on both sides. This includes how much the employee will make, their benefits, hours, position, responsibilities, and any other expectations that can include non-compete clauses or termination notice periods. These agreements allow for negotiation on both sides and will help you protect yourself as well as protect the employee. If problems arise in the future, the employment agreement can be looked at to see if resolutions have already been set forth or agreed upon. An agreement like this should also be signed by independent contractors that you hire in order to ensure their duties and compensation are understood prior to their contracts beginning.

Work Visas
If you or your employees plan on physically working in the U.S., a decision will need to be made about what type of U.S. Employment Visa to pursue. Initial visits to the U.S. can be accomplished with a simple B2 Visitor Visa, or if you are in a country where there is a Visa Waiver Program, an ESTA Visa. Visitor Visas are limited in time, and employees cannot be paid while in the U.S., however, they would be able to conduct business such as setting up a lease for office space or signing contracts with U.S. companies you plan to do business with. Once the initial framework of the business is set up, an Employment Visa will be required and you would want to apply for Employment Visas as soon as possible as there is significant processing time with U.S. Immigration (USCIS), and/or the U.S. Department of State (DOS).
Investor Visas
If you are planning on opening or already have opened a business in the US, you most likely already qualify for an employment or investor visa and its probably worth it once your travel either becomes or looks like it will become more regular.
