The same is true with lawyers. I get calls all the time asking about divorce, bankruptcy, child custody, or minor criminal cases. I refer all of these out to other attorneys. I know a little bit about each of these areas, but (most importantly) I know that I am not a specialist in any of these areas. I would not be able to help my client nearly as well as an attorney who has spent their career focusing on one of these areas. Likewise, I know lawyers who work in real estate their whole career who would have a nervous breakdown if you put them in front of a jury.

Corporate Law
A general practitioner is often just knowledgeable enough to be dangerous. A few years back, I was involved in a bitter dispute between three owners of a very profitable company. We took aggressive action early on, and the applicable Ohio statutes gave the opposing side a specific deadline to respond. The other attorney was a general practitioner (and a very good lawyer), but he did not have experience in corporate law specifically. Unfortunately, he was not aware of the statutory deadline, and moved forward in the case without taking the proper responsive actions. Months later, when the court was dismissing his case against my client, the judge asked the attorney why their client had not complied with the deadline. The attorney had to admit to the judge that he had no idea the deadline even existed, because it was tucked away in a section of the Ohio corporate laws that were not well-known. That mistake, while understandable, did not prevent the court from throwing out the opposing case. With only our side’s claims alive, we were able to dictate the terms of the settlement.
Business Disputes

Construction Contracts
First, (an issue that applies in every state) is the fact that some construction contracts do not allow for litigation through the court process. Many contain arbitration clauses that require a suit to be brought through a private service. Normally, this should not create a problem, unless the attorney fails to read the contract carefully. I have seen plenty of cases that were incorrectly filed in Common Pleas Court, only to end up being sent to arbitration. The sad result is that a homeowner could find their timeline pushed back 6 months because of their attorney’s lack of attention to detail.

Employment Discrimination
This blog is too short to go into all the factors that make for a viable case of employment discrimination, so I would always recommend calling an attorney to go over your situation. However, sometimes it turns out that there is nothing legally you can do about being fired or disciplined. If the company thinks that you are bad at your job, they can fire you (even if they are wrong). If the company thinks a problem in the workplace is your fault, they can fire you (even if they are wrong). What they cannot do is fire you because of your race, sex, or religion and then pretend it is for some other reason. A good lawyer can help spot the difference and use available discovery tools in litigation to get to the root of the issue.
Employment Contract
Have you heard of a covenant not to compete, sometimes called a non-compete? It is a clause that appears in many employment contracts. A non-compete provides that after termination of the relationship, the employee agrees not to compete against the employer within a specified geographic region for a certain period of time. Are they enforceable? Brace yourself for the classic attorney answer: it depends.

Construction Litigation
In my career, I have represented both homeowners and builders in construction litigation cases, so I have seen the disputes from both sides. Ohio law provides some interesting wrinkles that must be navigated in order for attorneys to effectively represent their clients’ interests.

Personal Injury
Even trial lawyers have specialties. Some spend their whole career only taking criminal defense cases. Others only practice personal injury or medical malpractice. Generally speaking, a civil litigator is an attorney who specializes in taking all kinds of civil cases through the court procedure, ending in either a trial or a settlement. These could be cases involving contract disputes, business disputes, construction, real estate, commercial cases, consumer cases, personal injuries, or any other case involving a dispute between two private parties. I personally have handled all of these kinds of cases, but less so with personal injury, as that tends to be its own specialty.
