DUI/DWI
In Alabama, driving under the influence is a law that prohibits anyone from driving or being in actual physical control of a vehicle while under the influence of any impairing substance that makes a person incapable of safely operating a vehicle. Driving under the influence (“DUI”) includes the influence of alcohol (BAC of.08% or more), drugs or a combination of the two. Any persons that is operating a vehicle under the age of 21 and has a BAC of.02 or higher can receive a driving under the influence charge.
Wrongful Death
A wrongful death lawsuit claims that the victim was killed as a result of negligence (or other type of unjust action) on the part of the person or entity being sued, and that the victim’s survivors or next of kin are entitled to monetary damages as a result of the unacceptable conduct. A Public intoxication (also known as “PI”) charge might not seem as serious of an offense compared to a misdemeanor or a felony, but the future consequences can be deemed comparable to that of greater offenses.
Drug Crimes
Under Alabama Code-Section 13A-12-211 a person commits the crime of unlawful possession with an intent to distribute if that person gives delivers, gives away, furnishes or distributes a controlled substance. The controlled substances that a person can be found unlawfully distributing can be found in Schedules I-V. Some of those substances are marijuana, opium, amphetamines and other substances that have high potential for abuse. Unlawful possession of drugs can be considered a class B felony, which can result in 20 years max prison time and up to $30,000 in fines.
