DUI/DWI
In California, it is against the law to drive under the influence of alcohol and/or drugs (DUI). Unfortunately, that doesnâ€™t mean that nobody drives drunk. In 2017 alone, 1,294 people were killed by drunk drivers, and an additional 26,967 people were injured. In that same year, 829 people were killed and 2982 people were injured by drivers who were under the influence of drugs.
Wrongful Death

Traffic Violations

Essentially, if a loved one dies because someone else did something careless or wrong, then their survivors may be able to file a wrongful death claim. This includes matters such as assault and battery, elder abuse, motor vehicle accidents...
Homicide
Importantly, heirs in a wrongful death action cannot recover punitive damages in almost all cases, which are meant to punish a wrongdoer for their conduct. The only exception is if the deceased was killed in a felony homicide for which the defendant has been convicted. However, punitive damages may be available through a survival action, as described above.
Hit and Run
