DUI/DWI
6. If you're in a car, the police need a specific reason to hit their red lights and pull you over. Be aware of the condition of your car and the rules of the road, to avoid giving them such a reason. The most common traffic violations that I've seen, which give the police reason to pull you over, are: no current registration tags, a brake light or headlight out, failing to signal while turning or changing lanes, failing to come to a complete stop, speeding, weaving (even within your own lane - that's considered "suspicion of drunk driving"), and changing lanes over a solid white line. If the police pull you over and you have not apparently violated any law, always be polite, but remember your case might be successfully challenged in court because your constitutional rights were violated.
Traffic Violations
Misdemeanors
In some cases, most commonly when the offense charged is a misdemeanor and you (the defendant in the court case) think you're guilty, you may feel that there's no need for a lawyer. You may have heard that a lawyer can't do anything to help you, or that you deserve whatever punishment you're going to get. Unfortunately, you may be wrong in these assumptions, and there's no way to tell unless you consult with a person licensed to give advice about California law.
Probation Violation
For many years, I helped clients who were facing probation violations. These kind of charges happen when clients are on probation, and must follow a certain number of rules, and they mess up. Sometimes the mistakes are honest mistakes, a forgotten date or a late payment of a fine. Many times, though, my clients were charged with violating their probation because the clients thought the probation officer would do something differently, or the clients did not really understand what was expected of them.
