Child Support
Attorney Jana R. Barnett regularly represents clients in child support matters. In Pennsylvania, parents are legally obligated to support their children who are eighteen years or younger, unless they are emancipated. The obligation to support will continue beyond a child’s 18th birthday if the child has not yet graduated from high school.
Child Custody and Visitation
Attorney Jana R. Barnett regularly represents clients involved in child custody disputes, including those who relocate and those who learn that the other parent will be relocating.
Adoption
Paternity
Determination. Where the paternity of a child born out of wedlock is disputed, the determination of paternity shall be made by the court in a civil action without a jury. A putative father may not e prohibited from initiating a civil action to establish paternity. The burden of proof shall be by a preponderance of the evidence. Bills for pregnancy, childbirth, postnatal care related to the pregnancy and genetic testing are admissible as evidence without requiring third-party foundation testimony and shall constitute prima facie evidence of amounts incurred for such services or for testing on behalf of the child. If there is clear and convincing evidence of paternity on the basis of genetic tests or other evidence, the court shall, upon motion of a party, issue a temporary order of support pending the judicial resolution of a dispute regarding paternity. The Supreme Court shall provide by general rule for entry of a default order establishing paternity upon a showing of service of process on the defendant and a subsequent failure to appear for scheduled genetic testing.
Premarital Agreement

Guardianship

Spousal Support
There are seventeen (17) factors which the court must consider when determining whether alimony is necessary and, if so, the nature, amount, duration and manner of payment of alimony. The statute does not specify the weight to give these factors.
Annulment
General rule. Upon the request of either party in an action for divorce or annulment, the court shall equitably divide, distribute or assign, in kind or otherwise, the marital property between the parties without regard to marital misconduct in such percentages and in such manner as the court deems just after considering all relevant factors. The court may consider each marital asset or group of assets independently and apply a different percentage to each marital asset or group of assets. Child Abuse

Sex Crimes
The types of bodily injury that can result in a PFA are intentional, knowing or reckless serious bodily injury, rape, involuntary deviate sexual intercourse, sexual assault, statutory sexual assault, aggravated indecent assault, indecent assault, and incest.
Misdemeanors
Pennsylvania law limits employers’ use of criminal convictions. The Pennsylvania Constitution states that, “all men are born equally free and independent, and have certain inherent and indefeasible rights, among which are those of enjoying and defending life and liberty, of acquiring, possessing and protecting property and reputation, and of pursuing their own happiness.” Pennsylvanians’ rights may be violated by public employers which consider their convictions unless the employers have a legitimate governmental goal for using this information, such as considering information which is reasonably related to a person’s fitness to perform a particular job. Similarly, the Criminal History Record Information Act, 18 Pa.C.S. §§9101 – 9181, states that most employers may only consider applicants’ convictions for felonies and misdemeanors if the convictions relate the person’s suitability for a specific job. They may not consider arrests which did not lead to convictions for felonies or misdemeanors. This law also states that if an employer decides not to hire a person because of the criminal history, the employer must give the applicant written notice of this decision. The notice is required even if the employer’s decision to not hire is based on multiple reasons, including the conviction. So long as the conviction is one factor in the employer’s decision not to hire, notice must be given.

Workers Compensation
In determining whether an individual is an independent contractor for purposes of the Workers Compensation Act or the Unemployment Compensation Law, the failure to withhold federal or state income taxes or pay unemployment compensation contributions or workers’ compensation premiums shall not be considered.
Wrongful Termination
Rejected applicants can sue the employer if the convictions do not relate to the person’s suitability for the job in question, or if the employer failed to disclose that the conviction was a basis for the decision not to hire. The Criminal History Record Information Act entitles a person to recover actual and real damages of at least $100 per violation, reasonable costs of litigation and attorney’s fees, and exemplary and punitive damages of $1,000 – $10,000 if the violation of the law is willful. Under common law, they also may sue for wrongful termination or failure to hire.
Employment Discrimination
When differences in pay are because of the employee’s sex, the person who receives the lower wages may also have a claim of sex discrimination under Title VII of the Civil Rights Act of 1964, and the Pennsylvania Human Relations Act.
Employment Contract
Despite the fact that Pennsylvania is an “employment at will” state, there are many matters with which Attorney Jana Barnett can help clients. Estate Planning
Wills
Like wills, “living wills” or “advance health care directives” enable you to control what happens. This document tells your health care providers and your loved ones whether you want certain kinds of medical or surgical treatment. Your instructions will be effective if you become unable to make these decisions yourself. Among the choices you can make in advance are whether to have your life prolonged as long as possible, diagnostic testing, a feeding tube, CPR, or mechanical respiration, or whether you simply want to be made comfortable and pain free. You should give a copy of your instructions to your doctor, family members, and other people who may be called if you have a medical emergency.
Power of Attorney
You may wish to designate someone as your agent to make health care decisions for you if you are unable to do so. The document which makes this designation is called a power of attorney for health care.
