General Info: Daniel Brook practiced medicine for many years prior to attending law school. He graduated from Yale University (B.S. cum laude, 1975), Mount Sinai School of Medicine (M.D., 1979). He did his Internship and Residency in Internal Medicine at Mount Sinai Hospital in New York City (completed 1982) and at Bronx V.A. Hospital a Chief Residency in Medicine (1983). Dan graduated from Fordham University School of Law in 2000. Since joining Gair, Gair, Conason, Rubinowitz, Bloom, Hershenhorn, Steigman & Mackauf he has become an indispensable part of the Medical Malpractice Department, evaluating potential medical malpractice claims and working with outside medical experts. He also assists the firm on medical-legal issues. His vast medical knowledge has proven to be invaluable to all our firm's attorneys in all areas of medicine.

It is more than three times more than the 525 accidents caused by drivers "following too closely," which is the second most common cause of accidents in New York City. Failure to yield the right of way caused 486 car accidents in February and was the third most common cause of crashes. Three hundred thirty crashes were caused by drivers who passed or used a lane in an improper manner. Two hundred seventy-seven accidents were caused by speeding. Drivers disregarding traffic control caused 220 crashes in February, and those who backed unsafely caused 217 accidents. Other human factors that caused more than 100 accidents each during the month of February were unsafe lane changing (172), turning improperly (160), drunk driving (160), and inexperience (156).

Unique, technical laws exist which govern the ability of an injured person to recover under these situations where a negligent driver has either no insurance or minimal insurance. Where the negligent driver is uninsured, it is often difficult for a person who is injured in a car accident to obtain appropriate compensation. If the injured party carries what is known as "uninsured motorist coverage" through their own automobile insurance policy, they may have a source of compensation in the event that the other driver fails to carry insurance or cannot be identified (i.e. a hit and run accident). More commonly, the offending driver is under-insured and carries inadequate insurance coverage, often at the minimum level required by state law. Many states have very low insurance requirements, which unfortunately means that some of the worst drivers on the road carry inadequate coverage due to the high cost of insurance which results from their bad driving records. Under the laws of certain states, a person may be able to protect themselves in the event that they are in an accident caused by somebody who carries inadequate coverage by purchasing additional coverage through their own insurance company.
