Criminal Defense
Well, prosecutors evaluate their cases just like criminal defense lawyers do. The first thing on their list of things that they evaluate when figuring out how to prosecute or whether to reduce a case is the level of their opposition. Obviously, if they're dealing with me as opposed to a younger attorney, they're going to know I'm going to be able to figure out what's wrong with a case, if the case has to go to trial, I'll try it. Just because you failed the field sobriety test or you've blown over the legal limit doesn't matter to me. I know there are defenses to that case. If you want to go to trial, I'm not going to force you to enter a plea, so prosecutors know that. So they want to win cases. Now, who do you think going to win cases if they tried the case, it ain't going to be me. It's going to be somebody else.

Traffic Violations
Driver appealed an order upholding his license suspension based on insufficient evidence to support the initial stop. The appellate court agreed holding language in the charging affidavit indicating the stop was for committing a traffic infraction without further explaination. The fact that there was a citation written for violating a traffic control device with (speeding) written on the ticket did not add any facts. Order sustaining suspension quashed.
Misdemeanors
If there is a prior refusal on your record and you've refused a breath or blood test or urine test a second time, that's an 18-month suspension of your license. You will get no hardship license during that 18 months, and they can also prosecute you as a first-degree misdemeanor for a second refusal. Florida law also requires, it's one of the few states that allows you to recant a refusal.

Under Florida law, a person who causes or contributes to the cause of a crash involving serious injury is subject to being charged with a DUI - Serious Injury. DUI - Serious Injury is a third-degree felony, level-seven offense, which means that penalties are severe. If convicted, you could be subject to a maximum of five years in the state prison. Under the Florida Sentencing Guidelines, a minimum mandatory sentence applies and is calculated based on various factors, including victim injury points. The more serious the personal injury, the more points earned. The mandatory fine for DUI - Serious Injury is the same as for felony DUI.
