Child Support

A transfer on death deed does not protect the property from creditors or Medicaid. If the property owner incurs debts or requires Medicaid assistance during their lifetime, the property may be subject to liens or claims against it. In addition, if the designated beneficiaries are minors or incapacitated adults, a guardianship or conservatorship may need to be established to manage the property on their behalf.

DUI/DWI
Attorneys Cohen & Winters are experienced DUI lawyers in New Hampshire. Driving while under the influence (usually called “DWI” or “DUI”) is defined in RSA 265-A:2. There are two basic ways that a driver can be guilty of DWI in New Hampshire: First, if the driver is operating a motor vehicle on a public way while under the influence (defined as “impaired to any degree”) of alcohol, a controlled drug, a prescription drug, an over the counter drug, or any other substance; Second, if the driver’s blood alcohol content is.08 or greater (.02 or greater if the driver is under the age of 21).
Traffic Violations
Placed on File Without Finding: Jonathan Cohen represented a man accused of speeding. Cohen was able to convince the arresting officer to allow the man to complete a safe driving course and the speeding ticket was placed on file without a finding. The man was able to avoid the fine as well as the points he would have received from the DMV if he had been convicted of that violation.
Sex Crimes
Special felonies are any felony that carries a sentence different than class A or class B. Most of these carry higher sentences than a class A. For example, murder, aggravated felonious sexual assault, and certain drug trafficking charges all carry more than a maximum of fifteen years. For this reason, many people believe a special felony is inherently more serious. However, some special felonies carry a lower sentence than a class B. For example, the special felony of driving after being a deemed a habitual offender carries a maximum of five years.
Misdemeanors
In New Hampshire there are three basic levels of criminal cases that have to do with the maximum possible punishment. Felonies carry the most possible punishment – at least one year in prison or more. Misdemeanors are crimes that may or may not carry jail time of no greater than one year. Violations are infractions that are not considered crimes under the New Hampshire criminal code. While all types of charges carrying varying degrees of fine, the main distinguishing difference to most people is the amount of possible incarceration.
Drug Crimes
Similarly, in the District of Columbia, possession of marijuana is illegal under D.C. Code § 48–904.01(d)(1). This law prohibits the possession of any amount of marijuana for personal use.

Probably the next most common type of personal injury case is what New Hampshire slip and fall lawyers call, “premises liability”.
