Criminal Defense
Michael J. Garvey has been practicing criminal law and helping reinstate client drivers licenses since 1991. He has successfully argued in front of the Illinois Supreme Court. In addition to the prospect of jail time, and the high probability of court supervision and steep financial penalties, there are drivers license revocation proceedings and other ancillary items. Traffic Violations
Traffic tickets are no longer a low-cost nuisance. Disorderly conduct is something of an umbrella term for a wide range of offenses in 720 ILCS 26-1. The statute covers a wide range of conduct, from alarm[ing] or disturb[ing] another to threats against public facilities to fake 911 calls. The range of punishment is equally broad, from Class C misdemeanor to Class 4 felony. Disorderly conduct can be charged as a stand-alone crime or along with other offenses. Also, it is a lesser-included offense in many weapons violations and other matters.
Drug Crimes
Heroin: A rising number of drug cases in Chicago and throughout the suburbs involve heroin. This substance is an example of a Schedule I drug, because it has no medicinal value, is very addictive, and very dangerous. In terms of quantity, anything over 99 grams may be a non-probation offense, meaning that a prison sentence is mandatory. The fine may be as much as $200,000.
Assault
Any disagreement between two or more people has the potential to become violent, especially if the dispute is a highly-emotional domestic disturbance or whenever alcohol is involved. So, assault and battery are among the more common charges in Cook County criminal courts. The punishment involved largely depends on the surrounding circumstances and the amount of force involved; the penalty may be anywhere from a few days in jail to years in prison. Regardless of the specific offense charged, the best defense is always to stand up for the defendants individual rights and force the state to prove its case.
